MASTER PLASTICS SW LTD – TERMS AND CONDITIONS OF SALE (WEBSITE & DISTANCE SELLING)


1. Definitions and Interpretation

1.1 “Company”, “we”, “us”, “our” means Master Plastics SW Ltd.
1.2 “Customer”, “you”, “your” means the person purchasing goods from us.
1.3 “Goods” means any products supplied by us.
1.4 “Contract” means any agreement between the Company and the Customer for the sale of Goods.


2. Basis of Contract

2.1 These Terms apply to all orders placed via our website or by distance means.
2.2 By placing an order, you agree to be bound by these Terms.
2.3 No variation shall apply unless agreed in writing.
2.4 We reserve the right to refuse or cancel any order.


3. Consumer Rights

3.1 Nothing in these Terms limits your rights under:

  • Consumer Rights Act 2015
  • Consumer Contracts Regulations 2013

3.2 These Terms distinguish between:

  • Consumers (private individuals)
  • Business customers (trade purchasers)

3.3 Business customers are not entitled to cancellation rights under distance selling regulations.


4. Orders and Acceptance

4.1 Orders are subject to acceptance and availability.
4.2 A contract is formed only when we confirm dispatch.
4.3 We may request further information before accepting an order.


5. Price and Payment

5.1 All prices are subject to change without notice prior to order acceptance.
5.2 Full payment is required before dispatch.
5.3 We reserve the right to refuse certain payment methods, including credit cards, due to processing costs.
5.4 Due to fluctuations in material and supply costs, prices may vary prior to confirmation.


6. Delivery

6.1 Delivery dates are estimates only and not guaranteed.
6.2 Unless otherwise agreed, delivery will be made within 30 days of contract formation.
6.3 Risk passes to the Customer upon delivery.
6.4 Ownership remains with us until full payment is received in cleared funds.

6.5 Delivery Conditions

  • Customer must ensure safe and suitable access
  • Appropriate personnel must be available to unload goods
  • Drivers are not responsible for carrying goods into premises

6.6 Failed Delivery

If delivery cannot be completed due to:

  • lack of access
  • absence of personnel
  • unsafe conditions

A re-delivery charge will apply.

6.7 Large / Heavy Items

For items over 20kg or 1.5m:

  • Customer must comply with Manual Handling Regulations 1992
  • Additional labour may be provided at extra cost

7. Glass and Fragile Goods

7.1 Customer must provide a safe, clean, flat surface for delivery.
7.2 Failure to do so may result in cancelled delivery and re-delivery charges.
7.3 Glass warranties:

  • Vertical units: 5 years
  • Roof glass: 3 years

7.4 Warranty covers replacement units only, not installation or associated costs.


8. Health and Safety

8.1 The Customer is responsible for:

  • risk assessments
  • safe handling of goods
  • use of appropriate equipment
  • trained personnel

8.2 We accept no liability for injury or damage arising from:

  • unsafe handling
  • failure to follow guidance
  • failure to notify safety concerns

9. Cancellation Rights (Consumers Only)

9.1 You have the right to cancel within 14 days without giving a reason.

9.2 The cancellation period expires 14 days after:

the day you (or a nominated third party) receive the goods.

9.3 To cancel, you must notify us by:

9.4 You must return goods within 14 days of cancellation.


10. Exclusions from Cancellation

The following cannot be cancelled:

  • Made-to-measure goods
  • Bespoke or custom products
  • Goods manufactured to specification

11. Returns and Refunds

11.1 Goods must be returned:

  • unused
  • in original condition
  • suitable for resale

11.2 Customer is responsible for return costs.

11.3 Standard delivery costs will be refunded.
Additional delivery upgrades are non-refundable.

11.4 Customer is responsible for goods until received by us.

11.5 Refunds will be processed within 14 days of receiving returned goods.


12. Faulty or Damaged Goods

12.1 We recommend inspection upon delivery.

12.2 Issues should be reported within 48 hours where possible.

12.3 This does not affect your statutory rights.

12.4 Under the Consumer Rights Act:

  • 30-day right to reject faulty goods
  • Repair or replacement thereafter

13. Product Information and Installation

13.1 Customers must follow all installation instructions.

13.2 Incorrect installation voids warranties.

13.3 uPVC and polycarbonate products expand and contract:

  • Allow ±15mm tolerance

13.4 Professional installation is recommended.


14. Manufacturer Warranties

14.1 Manufacturer warranties are provided in addition to your statutory rights.

14.2 We remain responsible for goods under applicable law.

14.3 Warranties cover product replacement only.


15. Limitation of Liability

15.1 Nothing excludes liability for:

  • death or personal injury caused by negligence
  • fraud
  • any liability that cannot be excluded by law

15.2 Our liability is limited to the value of the goods supplied.

15.3 We are not liable for:

  • loss of profits
  • loss of business
  • indirect or consequential losses

16. Website Use

16.1 You must not:

  • misuse the website
  • introduce viruses
  • engage in unlawful activity

16.2 Content may not be copied or reproduced without permission.


17. Data Protection

17.1 We comply with:

  • UK GDPR
  • Data Protection Act 2018

17.2 Personal data is handled per our Privacy Policy.


18. Force Majeure

We are not liable for delays caused by:

  • weather
  • supply chain disruption
  • transport issues
  • events beyond our control

20. Intellectual Property

Courts of England and Wales have exclusive jurisdiction.
